We recommend that you carefully go through our Terms of Use, to better understand the different features of our service. By subscribing to the registration process at HiFi Library, Members accept all items in the Terms of Use and agree to abide by and be legally bound by the Terms of Use.

Acceptance of Terms of Use These

"Terms Of Use" govern your use of the HiFi Library Website hereinafter referred to as "Service". The Service is owned and operated by Knowledge Management & Library Consultants (hereinafter referred to as "KMLC") and is offered to you (hereinafter referred to as "Member") as per your agreement with and acceptance of this document (hereinafter referred to as "Membership"). By clicking the box entitled "I Have Read and Accept the Terms of use" as part of the registration process, Members accept all items in the Terms of Use and agree to abide by and be legally bound by the Terms of Use.

By visiting HiFi Library Website, you accept and agree to abide by these Terms of Use. If you do not agree to these Terms of Use, you should not use the HiFi Library Website.

These Terms of Use are an ongoing contract between you and HiFi Library and apply to your use of the HiFi Library service and Website. These Terms of Use affect your rights and you should read them carefully.

Changes to terms of Use

HiFi Library reserves the right, from time to time, with or without notice to you, to change these Terms of Use in our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on the "Terms of Use" located at the bottom of the pages of the HiFi Library Website. The most current version of the Terms of Use will supersede all previous versions. Your use of the HiFi Library Website or continued use of our service after changes are made means that you agree to be bound by such changes.

Privacy

Any information submitted on the HiFi Library Website is subject to our Privacy Policy, the terms of which are incorporated herein. Please review our Privacy Policy to understand our practices (located at the bottom of the pages of the HiFi Library Website)

HiFi Library Service

HiFi Library is an online subscription based rental service that allows its members to rent books through its website located at https://www.hifilibrary.com. To use HiFi Library, one will have to register with HiFi Library to create an account and become its member. A member can then search Books / Children’s Books / Comics that he/she would like to read, and place hold on them. The first set of books will be delivered to the member at the shipping address provided at the time of registration. The number of books delivered at a time by HiFi Library is as per his/her membership plan. Once a member is done with the first set of books, he/she goes to www.HiFiLibrary.com and navigates "Pickup and deliver" (if you want the next book to be delivered) or just "Pickup" (if you do not want the next set of books now). We would pickup the books that you have with you and deliver the next set of books from your booklist (if you have selected for pikcup and delivery) within 2-3 working days.

Eligibility

Any individual who submits a completed application form for membership with mobile phone number, shipping address and communicable email address is welcome to sign up with HiFi Library. However, HiFiL ibrary reserves the right to accept or reject membership at its sole discretion. Except for Corporate Membership, all other memberships are for personal use only. No member may re-lend books borrowed from HiFi Library at any time. Doing so will entail automatic cancellation of membership.

Plans & Payment terms

By subscribing to a specific membership plan of HiFi Library, the member is explicitly agreeing to pay, in advance, the reading fee attached to the plan plus and any other applicable fee or tax at the frequency specified by the plan. Any non-compliance with the payment terms in spite of 2 reminders will attract a penalty of 10% per payment period of the amount due and may lead to cancellation of membership.

Membership fees

Reading fees should be paid as per the plan. In the event a member does not renew his/her subscription the company reserves the right to adjust the deposit amount towards the reading fees. If there is no balance in the Deposit Amount, then the company will terminate the membership of the member. All correspondence in this regard will be communicated to the email address of the member as submitted in the application form. Members are requested to update their contact details periodically when changed. Reading fee paid in advance will not be refunded.

Billing

By using the HiFi Library service, you are expressly agreeing that we are permitted to bill you subscription fee, any applicable taxes and any other charges you may incur in connection with your use of the HiFi Library service. Additional charges may include books you fail to return, or a billing plan change you request. As used in these Terms of Use, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method. The subscription fee will be billed at the beginning of your subscription and on each subscription renewal thereafter unless you cancel your membership. We will automatically bill your Payment Method on the calendar day corresponding to the commencement of your membership. All fees are non-refundable and there are no refunds or credits for partially used periods. We may change the fees in effect, or add new fees from time to time, but we will give you advance notice of these changes by email. In case the bills are not paid as on the due date, your account will be suspended and you will not receive any further books, till such time the payment is made. In case of your account suspension, you will have to return the books with you within seven days.

Definition of a BOOK

Since the reading fee is a flat rate and is not linked to the number of books read in a period, it is important to note that each title catalogued in HiFi Library gets the same treatments irrespective of size, cost & target reader. Children’s books and Comics are treated the same way as other books.

Reading period

At HiFi Library, you have the freedom to read the book/s at leisure, as there is no late fee. However, under specific circumstances where other library members have requested for and are waiting for a book/s for more than 10 days, HiFi Library reserves the right to contact and request members holding book/s to be returned. Members are requested to then return the requested book/s within five days of such request.

Book pickup and delivery

Books will be delivered within 2-3 working days provided the books are available in the Library and not issued to other members. Factors that may affect delivery times, include, but are not limited to, (i) the distance between the distribution centre from which your book(s) was shipped and your delivery address, (ii) the timing of your placement or adjustment of books in your queue. We do not process returns or deliveries on National Holidays. We make no guarantee as to the shipping and delivery of book(s) and may in our sole and absolute discretion, change our business practice regarding allocation, delivery and shipping, without notice. We may from time to time revise these Terms of Use but we will not necessarily provide you notice of the revisions. It is up to you to review the Terms of Use frequently to determine if there have been any changes made.

Lost or Damaged Books

At HiFi Library, we take utmost care to maintain books in good condition. Any anomaly (unprinted pages) of damage if found should be reported to the delivery executive. Failure to check and/or report the same will be constituted as if the member has received a book in good condition. While returning the book, the deliver executive will check for any damage of book(s) and report to the member accordingly. The determination of a book being “damaged” will be at the sole discretion of HiFi Library. For damage to / loss of any Book / Children’s Book or Comic, the member has to pay the replacement. For Scribbling or torn pages in Books / Children’s Books / Comics, an amount of Rs.50 per damaged item will be charged.

Membership closure & refund of deposit

No premature closure of membership is allowed. The deposit will be refunded only on completion of the period of membership. Under extreme situations caused by non-compliance to the Terms of Use by member, HiFi Library reserves the right to terminate a membership for any or no reason without any refund. Unclaimed Refundable Deposit

Upon expiry of membership, HiFi Library sends reminders over emails to its members for renewal. Three months after expiry, HiFi Library reserves the right to classify the account as ‘Dormant’ and initiate steps to recover cost of books and any unpaid reading fee from the refundable deposit, if there is no action on the reminders, which would be communicated to the member through emails. Post this recovery, any excess deposit left in the account will be retained as “Unclaimed” refundable deposit for a period of 3 months and periodic reminders would be sent to the member to claim the same. After 12 months of expiry of membership, HiFi Library reserves the right to treat the member as “not reachable” and take appropriate action on the unclaimed refundable deposit if there has been no response from the member on the reminder communications.

Use of Information submitted

Knowledge Management & Library Consultants, is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send to HiFi Library ("Content"), including, without limitation, responses to questionnaires or through postings to the HiFi Library Website without further compensation, acknowledgement or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the HiFi Library Website or other Websites. Furthermore, by posting any Content on our site, submitting Content to us, or in responding to questionnaires, you grant us a perpetual, non-exclusive, royalty-free irrevocable license and right to display, use, reproduce or modify the Content submitted in any media, software or technology of any kind now existing or developed in the future. Please note HiFi Library does not accept unsolicited materials or ideas for use or publication, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to HiFi Library. Should you send any unsolicited materials or ideas, you do so with the understanding no additional consideration of any sort will be provided to you, and you are waiving any claim against HiFi Library and its affiliates regarding the use of such materials and ideas, even if material or an idea is used that is substantially similar to the idea you sent.

Electronic Communications

By using the HiFi Library service, you consent to receiving electronic communications from HiFi Library. These communications will include notices about your account (e.g., shipping and receiving e-mails and other transactional information) and information concerning or related to our services. These communications are part of your relationship with HiFi Library and you receive them as part of the HiFi Library subscription. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing

Your conduct on the HiFi Library website & Limitation of Use

By accessing the HiFi Library Website, you agree not to upload, post, e-mail or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the HiFi Library Website. You also agree not to interfere with the servers or networks connected to the HiFi Library Website or to violate any of the procedures, policies or regulations of networks connected to the HiFi Library Website, the terms of which are incorporated herein. You also agree not to impersonate any other person while using the HiFi Library Website, conduct yourself in a vulgar or offensive manner while using our service, or use the HiFi Library Website for any unlawful purpose

Some of the hyperlinks and banners on the HiFi Library Website may lead to other Websites that are not controlled by, or affiliated with Knowledge Management & Library Consultants. In addition, other Websites may link to the HiFi Library Website. HiFi Library has not reviewed these Websites and is not responsible for the content or privacy policies of these Websites.

Confidentiality

You are solely responsible for maintaining the confidentiality and security of your account information and your password. If you reveal your password or share your account with anyone, you take full responsibility for his/her actions.

Indemnification

You agree to indemnify and hold harmless HiFi Library and its proprietor, directors, officers, employees, agents or other representatives from and against all claims, liability and expenses, including all legal fees and costs arising from or relating to (a) your breach of these Terms of Use; and (b) your use of this website and associated services including transmission or placement of information or material by you on this website. This provision shall survive the termination of your right to use this website and/or your status as a HiFi Library member.

Copyright

All content included on the HiFi Library Website and delivered to members as part of the service, including book(s), text, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, and software, is the property of, or its suppliers and is protected by the Indian and international copyright laws. The compilation of all content on this site is the exclusive property of Knowledge Management & Library Consultants, and protected by the Indian and international copyright laws. Content shall not be reproduced or used without express written permission from Knowledge Management & Library Consultants, or its suppliers. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the HiFi Libraray Website, not to insert any code or product or manipulate the content of the HiFi Library Website in any way that affects the user's experience, and not to use any data mining, data gathering or extraction method. HiFi Library reserves the right to terminate your membership hereunder if HiFi Library, in its sole and absolute discretion, believes that you are in violation of this paragraph, such violations including the photo copying of book(s) rented to you by us or the copying or other unauthorized use of our proprietary content. HiFi Library does not promote, foster or condone the photocopying of book(s) or any other infringing activity. The use of book(s) rented to you by us is solely for your personal and non-commercial use.

Third party content

We distribute books and we reserve the right to display and promote the information on our Website to you in any manner we choose in our sole and absolute discretion. In addition, the HiFi Library Website allows you and other third parties to post reviews or comments concerning the books rented out by us. Any opinions, advice, statements, services, offers, or other information that constitutes part of the content expressed or made available by third parties on the HiFi Library Website are those of the respective authors and not of Knowledge Management & Library Consultants, or its proprietor, directors, officers, or employees. Under no circumstances shall Knowledge Management & Library Consultants, or its proprietor, or its directors, officers or employees be held liable for any loss or damage caused by your reliance on information obtained through the HiFi Library Website. It is your responsibility to evaluate the information, opinion, advice, or other content available through the HiFi Library Website.

Data Security Policy

Information provided by a member, while signing up to services, such as identification and contact details, will be for the exclusive use of HiFi Library. HiFi Library may use this information to send regular communications about service related, third party source or any other relevant information. HiFi Library uses the information collected from you to provide you with access to our services and services from our affiliates and to monitor your use of such services.
